1. Introduction & Acceptance
These Terms & Conditions (“Terms”) govern your access to and use of the Apex Vitality
website, member platforms, telehealth services, programs, products, and related
services (“Services”).
By accessing or using our Services, you agree to be bound by these Terms and our
Privacy Policy. If you do not agree, you must not use our Services.
2. About Us
Apex Vitality is the trading name of Vitalis 3.0 Pty Ltd, an Australian company providing
doctor-led health, performance, and longevity services, including diagnostics,
coaching, telehealth, digital platforms, and eCommerce offerings.

3. Eligibility & Use
You must:
• Be at least 18 years of age
• Provide accurate, complete, and current information
• Use the Services only for lawful purposes
We may suspend or terminate access if you breach these Terms or misuse the Services.
4. Nature of Services (Important)
4.1 Not Emergency Care
Apex Vitality does not provide emergency medical services. If you require urgent or
emergency care, contact emergency services immediately.
4.2 Individualised Medical Care
All medical, diagnostic, and coaching services are:
• Individualised
• Based on the information you provide
• Subject to clinical judgment and practitioner discretion
No outcomes are guaranteed.
5. Telehealth Services
Telehealth services are provided:
• Directly by Apex Vitality clinicians; and/or
• By independent medical practitioner partners using our platform
By using telehealth services, you acknowledge:
• Telehealth involves inherent technical and privacy risks
• Clinical decisions are based on information available at the time
• Certain conditions may require in-person assessment or referral

6. Practitioner Partners
Where services are delivered by practitioner partners:
• Those practitioners operate under their own professional registration and
obligations
• Apex Vitality may act as a facilitator or service platform
• Clinical responsibility rests with the treating practitioner
7. Memberships, Programs & Subscriptions
7.1 Membership Access
Certain Services require an active membership or program enrolment.
We may modify, suspend, or discontinue Services with reasonable notice.
7.2 Renewals
Where applicable, memberships or programs may auto-renew unless cancelled in
accordance with stated terms at purchase.
8. Payments, Pricing & Refunds
8.1 Pricing
All prices are listed in Australian dollars unless stated otherwise and may be subject to
change.
8.2 Payments
Payments must be made in full before access to paid Services or products is granted.
8.3 Refunds
Refunds are handled in accordance with:
• Australian Consumer Law
• Any specific refund policy disclosed at purchase
Clinical services already rendered are generally non-refundable.
9. eCommerce & Products
Products sold via Apex Vitality (including supplements or digital products):
• Are provided for general support purposes only
• Are not a substitute for medical advice
• Must be used as directed
Always consult your treating clinician before starting new supplements or products.
10. Intellectual Property
All content, branding, systems, and materials provided by Apex Vitality are owned by or
licensed to us and protected by intellectual property laws.
You may not copy, reproduce, distribute, or exploit any content without written
permission.
11. User Conduct
You agree not to:
• Misuse the Services
• Interfere with platform security or functionality
• Upload false, misleading, or unlawful content
• Harass, abuse, or impersonate others
We reserve the right to restrict or terminate access for breaches.
12. Disclaimer & Limitation of Liability
To the maximum extent permitted by law:
• Services are provided “as is”
• We do not guarantee outcomes, results, or uninterrupted access
• Apex Vitality is not liable for indirect, incidental, or consequential losses
Nothing in these Terms excludes non-excludable rights under Australian Consumer
Law.
13. Privacy
Your use of the Services is subject to our Privacy Policy, which governs how we collect,
use, and store personal and health information.
14. Termination
We may suspend or terminate access:
• For breach of these Terms
• For misuse or risk to patients, clinicians, or the platform
• Where required by law or regulation
Termination does not affect accrued rights or obligations.
15. Governing Law
These Terms are governed by the laws of Victoria, Australia. You submit to the
exclusive jurisdiction of Victorian courts.
16. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services
constitutes acceptance of the updated Terms.
